DOT Employers and Owner Operators

Random drug testing programs are required for employers regulated by the United Stated Department of Transportation (DOT). If you are an owner operator, you are required to be enrolled into a consortium random drug testing program. Smaller DOT regulated employers may also elect to enroll into a consortium random drug testing program for easy compliance. Larger DOT regulated employers typically request a stand-alone DOT random testing program.

Owner-Operators

For owner-operators two important steps must be taken to comply with the DOT FMCSA regulations for drug and alcohol testing:

  1. A pre-Employment test drug test with a negative result must be completed before operating a DOT covered commercial motor vehicle (CMV).
  2. You must enroll into a random testing consortium. Owner-operators are not permitted to manage random testing themselves.

Trucking Companies, Bus Companies, For Hire Carriers and Private Fleets

Both stand-alone random testing pools and consortium random testing pools are available for trucking companies, bus companies, for hire carriers and private fleets. Typically companies with over 20 drivers will elect to have a stand-alone random drug testing program. The DER also receives test results and other communications for the employer. Only an employee (or the employer directly) may act as a DER. This is one of the only roles that a service agent can never perform.

How do you know if you are regulated by the Department of Transportation (DOT) and the Federal Motor Carrier Safety Administration (FMCSA) for drug and alcohol testing? The DOT drug test test is a 5 panel + expanded opiods test that includes marijuana, cocaine, PCP, amphetamines and opiates.

A post accident drug test is only required under the DOT if there is a human fatality, bodily injury with immediate medical treatment away from the scene or disabling damage to any motor vehicle requiring tow away.

USCG requires 50% of people enrolled to be tested for drugs.

PHMSA requires 50% of people enrolled to be tested for drugs.
